These Terms and Conditions define the rules for the provision of services by Grafoto and the use of the website.
§1. Definitions
- Service Provider / Grafoto — Grafoto Marek Wroński, ul. Akacjowa 58a, 55-093 Kiełczów, Poland, Tax ID (NIP): 615 203 42 61, tel.: +48 733 223 225, e-mail: kontakt@grafoto.pl.
- Client — a natural person, legal entity, or organizational unit ordering services.
- Services — real estate photography, 360° virtual tours, video presentations, drone services, and related services.
§2. Scope of Services
Grafoto provides services in the field of visual marketing for real estate. The detailed scope, deadline, and remuneration are determined individually through an order or agreement.
§3. Conclusion of Agreement
The agreement is concluded upon the Client's acceptance of the offer/quote presented by Grafoto. The pricing provided on the website (calculator) is for informational purposes only and does not constitute an offer within the meaning of the Civil Code.
§4. Execution and Deadlines
The completion date is determined individually. The Client is obliged to provide access to the property and prepare it for the session. Grafoto is not responsible for delays resulting from reasons attributable to the Client or weather conditions (applies, among others, to drone services).
§5. Remuneration and Payments
The remuneration is specified in the accepted quote. Payment is made on the basis of an invoice, within the deadline indicated therein, by bank transfer to Grafoto's account.
§6. Copyright and License
Materials (photos, videos, 360° tours) are works within the meaning of the Copyright Act. Upon payment, the Client receives a license to use the materials for the marketing of the given property (publication on listing portals, social media, on the Client's website). Economic copyrights and the right to use the materials in Grafoto's portfolio remain with Grafoto, unless the parties agree otherwise in writing.
§7. Complaints
Complaints should be sent to kontakt@grafoto.pl. We consider complaints within 14 days from the date of receipt.
§8. Right of Withdrawal (Consumers)
Consumers have the right to withdraw from a distance agreement within 14 days, subject to the exceptions provided for in the Consumer Rights Act (including services fully performed with the consumer's express consent and materials prepared to individual order).
§9. Final Provisions
For matters not covered herein, the provisions of Polish law shall apply. Grafoto reserves the right to amend these Terms and Conditions — any changes shall not affect the acquired rights of the Clients.
